Description
This presentation will explore recent national litigation trends involving assisted living communities and how those may compare to what is traditionally seen in the skilled nursing facility litigation context.  The presentation will dive deep into jurisdictional trends as well as explore risk mitigation techniques, including those that may assist providers in addressing acuity challenges and resident retention issues.

Objectives

Following this presentation, participants will:

  1. Gain a deeper understanding of jurisdictional litigation trends involving assisted living communities, including learning about recent litigation involving inappropriate admissions and retentions of residency;
  2. Learn how external staffing assistance can mitigate certain litigation against communities and learn more about how a facility’s own home service or home nursing agency can assist with acuity challenges;
  3. Discuss recent state regulatory challenges for both assisted living providers and those with similar licensures, such as sheltered care providers.

Speaker Bios

Adam Guetzow advises clients in the full continuum of aging service and long-term care providers, including home service agencies, assisted living facilities, sheltered care facilities, continuing care retirement communities (CCRCs), and skilled nursing facilities. Adam regularly defends litigated matters brought under state and federal statutory provisions. He also represents aging service providers in administrative actions before both state Departments of Public Health and the Centers for Medicare and Medicaid Services. Adam is the chair of the firm’s national Health Care Practice Group.

David Alfini provides results-oriented counsel and legal representation to assisted living/residential care facilities (RCFE) and skilled nursing facilities, continuing care retirement communities (CCRC), nursing homes and independent living communities, as well as home health, home care, and hospice agencies. His goal is to help them manage risk and achieve their business objectives, both in and out of the courtroom. David divides his time between Hinshaw’s Los Angeles and Chicago offices, representing facilities and aging services companies nationwide, including in California, Illinois, and Indiana.
