Adverse events in senior living are inevitable, but how an organization responds will often determine whether the matter resolves or escalates into litigation. This session provides practical strategies to mitigate the impact of a claim from the event through trial. Attendees will learn how to respond effectively in the immediate aftermath of an event and identify situations likely to develop into lawsuits. The session emphasizes early actionable strategies that improve outcomes and defensibility. Participants will also gain a clear understanding of the litigation cycle, with practical guidance for depositions, mediation, and trial.

Objectives:

At the conclusion of this session, participants will be able to:

• Identify appropriate immediate response actions following an adverse event including safety, scene control, reporting and evidence preservation.
• Apply best-practice communication techniques with residents/families after an event that is factual, consistent, and demonstrates empathy while avoiding blame or admissions of fault.
• Describe and evaluate the components of a thorough and defensible investigation, including documentation practices, structured witness interviews, and identification of contributing factors and root causes.
• Execute key documentation and evidence preservation processes necessary to reduce liability exposure and avoid spoliation risks.
• Identify and assess indicators of potential litigation and evaluate situations likely to develop into claims and explain the stages of the litigation process including the organization’s role in depositions, mediation, and trial.
