Predictive fall-detection systems and predictive care analytics are no longer pilots — they’re operational, and they’re already shaping how claims, coverage, and courtrooms are treating tech-mediated care decisions. This session gives board members, CEOs, and senior leaders a practical framework for staying ahead of that curve: understanding where liability actually surfaces, what “good governance” looks like before a tool scales, and how to build the oversight and documentation that let your organization lead with confidence rather than react after the fact.

Using real-world scenarios and the current litigation landscape — including active federal cases testing how courts treat algorithm-driven care decisions — this session walks through the questions your organization should be able to answer today: who relied on the alert, who could override it, and what you’d show a family, a regulator, or a carrier if the tool got it wrong.

Session Objectives:

At the conclusion of this session, participants will leave with a framework for evaluating any current or proposed technology deployment before it becomes a claim.

1. 1. Identify where legal and regulatory exposure actually arises when predictive analytics or monitoring technology is used in resident care — and why liability rarely rests with the algorithm itself.
   2. Apply a four-part evaluation framework (Outcome, Decision, Control, Response) to assess any current or proposed technology deployment for governance gaps before it scales.
   3. Determine the minimum contractual, coverage, and human-oversight controls — vendor terms, override authority, escalation protocols, coverage alignment — that should be in place before piloting or expanding predictive care technology.
   4. Prepare the documentation and reporting posture the organization would need to defend a technology-related claim or regulatory inquiry when a tool’s output turns out to be wrong.
