Description:
Healthcare organizations including Senior Living providers are among the most frequently pursued cyberattack targets, largely because the data stored in their computer systems is a lucrative currency to hackers and requirement for uninterrupted operations. News of a Healthcare security breach or ransomware incident has become almost commonplace, as hackers develop increased proficiency in identifying and exploiting security vulnerabilities in healthcare IT security. These attacks cost healthcare providers millions of dollars, generate negative publicity, cause reputational damage, and can instigate OCR investigations. While no organization is completely safe, there are practical, ethical, and legally required steps to take to protect your organization and manage cyber risk. This presentation is focused on helping providers understand and practically prepare for the inevitable.
Objectives:

- Understanding the landscape. We will assist with identifying the legal framework and regulatory considerations including the Office for Civil Rights (HIPAA), state attorneys general (HIPAA, state data breach laws and state consumer protection laws), the Federal Trade Commission (PHRs).
- We will be discussing how Risk Management works- how to build the right framework and thinking about discussing with IT systems owners/business teams; Management, the C-Suite, and the Board. Understanding the changing landscape of cyber coverage will be key in obtaining coverage, maintaining coverage and how to handle contract negotiations and the inevitable loss of coverage by a key vendor.
- We will provide a practical checklist of recommended items and steps senior living organizations can take to prepare.

John P. DiMaggio, QTE
John DiMaggio is the co-founder and CEO of Blue Orange Compliance, a firm dedicated to helping health care providers and business associates navigate the required HIPAA and HITECH Privacy and Security regulations. John is a recognized healthcare information compliance speaker to state bar associations, HIMSS, Health Care Compliance Association (HCCA) and long-term care associations including Long Term and Post-Acute Care (LTPAC), NAHC, LeadingAge and Argentum. John is also a LeadingAge CAST Commissioner.
Alisa L. Chestler, CIPP/US
Ms. Chestler serves as the chair of the Data Protection, Privacy and Cybersecurity Team at Baker Donelson and the Past Chair of the Health Information Technology Practice Group of the AHLA (2018-2022). She concentrates her practice in privacy, security and information management issues including compliance, technology agreement negotiation and corporate transactions matters. She joined Baker Donelson after a distinguished career as in-house counsel and privacy officer to several large public and private companies.
