This comprehensive webinar is designed to equip membership with the knowledge and tools necessary to effectively prepare for and navigate litigation. Attendees will gain a thorough understanding of the steps to take immediately following a significant event, as well as the intricacies of the litigation process. This session aims to enhance preparedness, ensure regulatory compliance, and minimize legal risks.

- Learn how to secure the scene and preserve evidence.
- Understand the importance of timely communication with residents’ families.
- Gain insights into reviewing and documenting resident care records accurately.
- Identify necessary regulatory reports and prepare for investigations.
- Develop strategies for managing staff and handling media inquiries.
- Navigate the Litigation Process:
- Understand the steps involved in filing and responding to a complaint.
- Gain knowledge of the discovery process, including interrogatories, document production, depositions, and the role of expert witnesses.
- Explore potential pre-trial resolution methods such as mediation, arbitration, and settlement.
- Learn what to expect during court proceedings and how to prepare for trial if a settlement is not reached.
Speaker Bios:
Josh Lauby brings focused experience to his role as Claims Counsel for Caring Communities. Prior to joining Caring Communities, Josh worked for 18 years as an attorney primarily defending long-term care facilities in litigation matters including medical malpractice, long-term care, premises liability, and wrongful death. He has significant experience in all facets of litigation in both state and federal jurisdictions; and has achieved successful results at trial, arbitration, and mediation. Josh holds a bachelor’s degree in political science from the University of Wisconsin-Eau Claire and a Juris Doctor from the University of Illinois Chicago School of Law.
