The Affordable Care Act’s Employer Shared Responsibility Mandate (“Mandate”) was introduced in 2014 and employers have adjusted their health plan eligibility and payroll processes accordingly. However, due to increased enforcement of the Mandate by the IRS and the significant penalties related to non-compliance, employers would be prudent to review their policies and practices related to complying with the Mandate. This webinar will review the Mandate’s rules related to determining full-time employees, highlight issues related to reporting offers of coverage, and responding to IRS enforcement letters.

Objectives:
As a result of this presentation, attendees will:

• Understand which Hours of Service to count toward determining an employee’s full-time status for purposes of the Mandate
• Understand how to determine an employee’s full-time status using the Look-Back Measurement Method
• Recognize certain reporting “red flags” that may lead to an IRS enforcement letter
• Know how to respond to an IRS enforcement letter

Speaker Bio
Mr. Wesley (Wes) Covert is a partner at Laner Muchin, Ltd., and a member of the firm’s Employee Benefits Group.  For the last 15 years, Mr. Covert has focused his practice on all aspects of employee benefits law, including health and welfare benefit plans, defined contribution plans, defined benefit plans, and multiemployer plans.  Mr. Covert’s practice also includes counseling clients as to compliance with various federal laws, including the Affordable Care Act, HIPAA, ERISA, the Internal Revenue Code, and the correction of qualified retirement plans through the correction programs available through the IRS and DOL.  He is a frequent speaker to benefit and human resource professionals and author on various benefit topics and provides training to HR Departments on a number of benefit-related matters.
